AGREEMENT FOR WEDDING PHOTOGRAPHY

Photography fee agreed to: $1,715 (plus applicable taxes)
1. This agreement constitutes an order for wedding photography services, including the taking of wedding pictures as agreed to by both parties—photographer (Mike Amera and/or Aw Sum Wedding Photos Ltd., both hereinafter known as the Photographer), and Contracting Party—and the provision to Contracting Party of proofs (4" X 6" prints, unless otherwise stated herein) which Contracting Party may retain. It is understood nonetheless that any and all proofs, final or sample prints and negatives or digital image files and all rights to them remain the property of the Photographer and may be used for advertising, display or any other purpose thought proper by the Photographer.
2. Although all care will be taken with negatives and/or digital image files and the photographs taken at the wedding, the Photographer limits any liability for loss, damage or failure to deliver pictures for any reason to the return of deposits made.
3. It is understood and agreed that no other photographer will be allowed to photograph or take pictures at the wedding while the Photographer is working, and that any breach of this agreement shall constitute a reason for non-completion of the job with no liability to the Photographer and shall result in the loss of any deposit(s) made by Contracting Party.
4. On signing of this agreement by both parties hereto, the Photographer will reserve the date and times agreed upon (Saturday, July 5, 2008 - starting at 2:30 p.m.) and will not make another reservation for the specific date and time frame. For this reason, all deposits are non-refundable even if the date is changed or if the wedding becomes cancelled for any reason.
5. The photography fee is $1,715.00 plus 5% sales tax, for a total of $1,800.75. A deposit of $600.00 is due at the signing of this agreement, with a further $600.00 to be paid at least two weeks prior to the wedding date (i.e. before June 21, 2008 ) and the remainder ($600.75) to be paid on the date of the wedding upon completion of photography.
6. Contracting Party hereby releases, discharges and agrees to save harmless the Photographer, its heirs, legal representatives, assigns, employees or any persons or corporations acting under permission or authority from the Photographer from and against any liability as a result of any distortion, blurring or alteration, optical illusion or use in composite form, either intentionally or otherwise, that may occur or be produced in the taking, processing or reproduction of the photographs.
